AN ACT CONCERNING LOOK-A-LIKE FIREARMS.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. (NEW) (Effective October 1, 2012) (a) As used in this section, "look-a-like firearm" means any imitation firearm, simulated firearm, replica of a firearm or other device which substantially duplicates or is so similar in coloration and overall appearance to an existing firearm as to lead a reasonable person to perceive that the device is a firearm.

(b) No person shall alter, change, deface, remove, paint, emboss or in any other manner obliterate any coloration or markings that are required by any applicable state or federal law or regulation for any look-a-like firearm, in a manner that makes the look-a-like firearm look more like a firearm. Any person who violates any provision of this subsection shall have committed an infraction. This subsection shall not apply to the use of look-a-like firearms in theatrical productions including, but not limited to, motion pictures and television and stage productions.

(c) No person shall possess any look-a-like firearm, paintball gun, pellet-firing air gun or BB. gun in or on, or within one thousand five hundred feet of, the real property comprising a public or private elementary or secondary school. Any person who violates any provision of this subsection shall be fined not more than five hundred dollars or imprisoned not more than three months or both.

(d) The provisions of this section shall not apply to any look-a-like firearm, paintball gun, pellet-firing air gun or BB. gun used by the Department of Emergency Services and Public Protection, police departments, the Department of Correction or the military or naval forces of this state or of the United States in the discharge of their official duties.

Statement of Purpose:

To make it an infraction for any person to deface the markings on any look-a-like firearm and to ban the possession of look-a-like firearms, paintball guns, pellet-firing air guns, and BB. guns within one thousand five hundred feet of, the real

This is a ridiculous overreach of our state legislature to ban air guns and replicas from private homes and properties all over Connecticut. 1500 feet is a huge radius around the 'real property' of a public school. It exceeds even the Federal law on carrying real firearms without a permit around schools.

This needs to be fought aggressively.

There is public hearing on March 1st, 2012.

Here is how to testify:
http://www.cga.ct.gov/asp/content/yourvoice.asp

We should all also be writing our legislators to tell them how distasteful and restrictive this is.

Everyone needs to get testimony submitted on this. Everyone needs to contact their representatives.
This is a huge overreach and needs to receive the scrutiny and outcry it is demanding.

Public hearing information:

*SELECT COMMITTEE ON CHILDREN
THURSDAY, MARCH 1, 2012
The Select Committee on Children will hold a public hearing on Thursday, March 1, 2012 at 2:30 P.M. in Room 1E of the LOB. Please submit 25 copies of written testimony to Committee staff at the time of sign up. Testimony submitted after sign-up may not be distributed until after the hearing. Sign-up for the hearing will begin at 1:30 P.M. in First Floor Atrium of the LOB. The first hour of the hearing is reserved for Legislators, Constitutional Officers, State Agency Heads and Chief Elected Municipal Officials. Speakers will be limited to three minutes of testimony. Unofficial sign-up sheets have no standing with the Committee.
SUBJECT MATTER: Child Related Bills
*S.B. No. 194 (RAISED) AN ACT CONCERNING THE POSTPONEMENT OF JURY DUTY FOR BREASTFEEDING MOTHERS.
*H.B. No. 5184 (RAISED) AN ACT CONCERNING DISSECTION CHOICE.

I'll be writing Senator Jason Welch. He's an outstanding CT lawmaker.

When I started helping on SB798 and NJ SB810 I told everyone, that states were going to looking closely to see what they could do. Given the recent events in our home state over the past 6 months, this was expected. We need to organize ASAP and stop it dead in its' tracks.

I've written and sent a letter to both Representative Whit Betts and Senator Jason Welch here in Bristol. As I stated before, they both do an outstanding job. I've written them previously on the proposed magazine limitation law the state Dem's wanted to pass a year ago and was pleased with the response then and henceforth.

This would make me a criminal the second it passes as I live between two schools, and pass several more on my way to both GZ and SP.

Please keep all letters respectful, and back up claims with proof. These gentlemen and women in office have earned their places for a reason, and raising their ire is not to be done lightly.

yeah. I was talking about the people who keep bringing antiairsoft stuff to the table, not the people who actually do their job (represent the people)

They are representing the people. The people they represent voted them into office. Not everyone understands firearms, and those have existed for hundreds of years. Expecting them to understand airsoft is a long shot.

jeebus. i live within 1500 ft of an elementary school too.

the worst part is that even if this passes - i will not get rid of my pellet or airsoft guns but this law would make me a criminal. and ironically my REAL firearms will remain perfectly legal.

This bill would kill airsoft in CT. I would say 65%-80% of us live within that range from a public or private school property. Also, we would all have to pass through those areas to get to a field. GZA Indoor is surrounded by 5 schools, Outdoor is 2 or 3 in the area. SP has at least 2 nearby. Cromwell; being in town, has to have 3-4 nearby.

thats a fine point warlock, I cant speak for GZA CQB but I do know that SP and Cromwell are in proximity to schools. A friend and I created a website that allowed people to automatically email every senator involved in any way with sb798 last year, we had almost 1000 entries over a 5 month period.

My friend and I are considering restarting the site to fight this bill. If anyone can get us a list of senators and politicians involved, it would be very helpful.

I just got off the phone with the research department of the State Legislature. Here's is what I have uncovered for the language of the proposed bill:

Real Property- Anything that is on the said land that cannot be removed easily. In the cases of schools, the towns own the land. So each town has their own "school Zones" that are marked at 1500 ft. per existing Firearms and Drug laws. So the language is no airsoft replicas with that school zone. Also, any other locations a school may have, such as a football or baseball field which is not connected to the school, but in another location, is considered school property.

Elementary and Secondary Schools- Pre-K thru 12th grade, Public and Private, some Pre-K's are separate from K-8, so they are another zone.(basically anywhere that has school zone signs)

Possession- physically on you, in a vehicle you are driving, in your home- considered possession(per courts)

So the State wants me to invest in real firearms and not fake ones while I'm living in a school zone?

so this makes sense how?

I live within 1500 ft of an elementary school, and since I own airsoft replicas in my household, I will now be a criminal?

But meanwhile my real steel M1911 will be perfectly ok to have in my house?

That's exactly what the proposed bill states. Everyone has to remember, under Fed. Law, Airsoft replicas are considered a toy. So they are not protected by Second Amendment rights. If the could pass something like this for real steel they would have long ago.

Just after a little research, there are approx. 1000 elementary and secondary schools in CT @ 1500 ft. on each side. The state begins to close in on areas where airsoft possession would be legal. A lot of these areas would also overlap, blocking out entire towns.

not feasible, there's all kinds of license/permits that would be needed to be this ". This subsection shall not apply to the use of look-a-like firearms in theatrical productions including, but not limited to, motion pictures and television and stage productions."

here we go another stupid law trying to be passed. I wonder how much this would effect peoples jobs and business sales? I wonder how many people this would drive to staying home and inside more? People just don't think when they try to pass these laws I wonder what group or people are lobbying for this law? Time to get the word out and write, call, email, visit, or what ever other means available to keep this law from being passed.

I think they are trying to pass this because some little dumbass brought an airsoft weapon to school and it didn't have an orange tip.
I'm telling you, we might have to start doing what they did in the UK with UKARA.

I would think in the future it would probably be wise to just keep this stuff within the established community. Last thing we want is a slew of poorly worded and written letters coming from people who shouldn't be writing them in the first place going to the people who actually make decisions. My facebook has been blown up with all sorts of misinformation about this stuff coming from sites, internet lawyers who feel they know the way things work, and straight ignorance.

While it is important that people know about this, I feel there has been a lot opinions being thrown around as 'facts' enthusiastically by some of the younger crowd.

California and Jersey have both tried to pass poorly thought out bills and been defeated.

While it is pretty evident they are trying to target kids who may bring airsoft replicas to schools, they will continue to do so regardless of what rules are on the books, this really effects most of us living or transporting gear through school zones. The wording makes it way to broad and open ended in interpretation.

^Repo is correct. With the anti SB798 website we developed, we allowed messages to be sent through the website to all of the people involved (senators, representatives, etc.), we posted a basic letter that 95% of people used but there were some idiots who wrote violent or just plain stupid emails. The few idiots who do stuff like this really damage the reputation of the community and causes the government to view us in the same way.

Any suggestions binky (or any other person knowledgeable with computers) on how to code a message box with some form of admin control over what is sent?
